Petition was made this morning before Surrogate George F. Ditmars
for the admission to probate of the will of Emily
H. Burnett, who died July 5 at Phelps. The petitioners are Jennie
W.
Burnett,
of Phelps, and Chester G. Blaine, of Lyons.
The amount of the estate is $5500. An objection to the probate was made
by Clyde W. Knapp, of the firm of Hamm & Knapp, of Lyons,
in the behalf of Edward Burnett, one of the sons of the
deceased, who was debarred by the provisions of the will from receiving
his proportionate part of the deceased's bank deposit. Upon request of
Attorney Knapp, the probate was adjourned until Dec. 13, and during the
interim Knapp will decide whether or not he will file formal objections
to the probate. Wilbur F. Osburne of Rochester, also appeared in the
interest of Charles Breisch and Julia Wyman, two
other legatees who reside in Phelps.
The will of the late Thomas J. Laws who died in the this city
July 5 was admitted to probate and Thomas J. Laws was
appointed executor. Charles N. Hemiup appeared for the petitioner.

In Surrogate's Court that has been a judicial settlement of the
accounts of Elizabeth Root as administratrix of the estate of Elizabeth
G. W. Root. The account showed the estate to amount to $25, 326. A
judicial settlement of the accounts of Thaddeus Oaks and William
Oaks as executors of
the $30,000 estate of Nathaniel Oaks has also been had. The
will of Ann Beattie has been probated Hessel A. Beattie was
named as executor. George Haskins and Charles N. Hemiup were
witnesses to the will which disposed of an estate of $2750.

Canandaigua, N. Y. - Frederick H. Scandling has been appointed
administrator of the estate of his mother, Mrs. Amelia C.
Scandling, who was killed in the automobile accident at Freshours
crossing east of this village last summer, when Dr. Waldron of
Rochester and three elderly women who were riding in his auto were
struck by a Rochester and Eastern trolley car and all the occupants of
the auto instantly killed. Her estate is valued at $2550.

Geneva. Willard C. McKelvie was named as executor of the
estate. This afternoon the will of Catherine Broderick was
admitted to probate.

Surrogate Ditmars at his regular session of Surrogate's Court issued
letters of administration to William A. Shepard as
administrator of the estate of Augusta Shepard, who died at
Canadice March 11, 1909. The deceased leaves property estimated at the
value of $4400. Letters were granted to George A. Jackson of
Geneva as administrator of the estate of Anthony Jackson, who
died at Geneva, March 6, 1909. The real estate of the deceased is
valued at $8000 and the personal property at $1300. Letters
testamentary were granted to Florence R. Smith as executrix of
the will of Quincy A. Smith, who died at Bristol April 14. The
real estate is estimated at $7500 and the personal property at $2000.

value of estate, $4800. Letter of administration were granted to Delzora
Swartz in the $3000 estate of Seymour Swartz, late of the

Canandaigua, N. Y. - At a term of Surrogate's Court held here
yesterday by Surrogate George F. Ditmars, the will of John Pestle who
died at this village July 14th this year was proven and admitted to
probate. The will bequeaths the real property of the decedent,
amounting to $1000, and the personal property of $125 to his only son, George
W. Pestle, of the town of Richmond, who is also the executor of
the will. The will of William Mamerow, who died at the Town of
Farmington September 26th, this year, was also proven and admitted to
probate. Anson L. Gardner was appointed special guardian for
two infants who are parties to the proceeding. All of the property of
the deceased passes by the will to the widow, Charlotte Mamerow. The
real property consists of $1400 worth of lands and the personalty of
about $800. The executor appointed by the testator in the will
renounced his rights to the testamentary letters, and no executor has
as yet been appointed.

In the estate of Thaddeus S. Rowley, who died in the town
of Bristol April 23d last, two executors, Mary Rowley and Augusta
Rowley, both of the town of Bristol, were appointed, they having
been named by the decedent as executors of his will. The widow, Mary
Rowley, according to the will, receives all the estate left by
decedent, but the amount of the property or what it consists of is not
given.

The will of Gertrude Thomas, who died in the town of
Victor on or about April 4, 1910, was submitted to probate without
opposition. The petitioner who asked for the probate of the will was Louis
A. Rugg of Victor, who is a legatee under the terms of the will.
The instrument is dated April 14, 1902, and disposes of all of the
property of the decedent which consists of about $2300 of personal
property but no real estate. The will appointed as executor Theodore
M. Norton, who resided at the village of Victor, but who has since
the execution of the will died, and it will be necessary to have an
administrator with the will annexed appointed by the court to take
charge of the estate. Henry W. Hamlin of this village was appointed a
special guardian to represent the interests of any infants that may be
connected with the estate. The papers filed show that a grandson of the
decedent, Fremont Thomas, is practically the only living heir
to her property and that he has not been heard from in over ten years,
when he paid a visit to his grandmother, the decedent, at her home in
the village of Victor. It is unknown whether the grandson is still
alive.
In the estate of Edward Renehan, formerly a resident of the
town of the town of Phelps, who died in that township March 9th,
letters of administration were granted to his widow, Anna Renehan. The
estate consists of about $400 in personal property and $1500 in real
estate. The administrator filed a bond of $800. The heirs consist of
the children of the decedent, Ellen, Charles, William, Adolphus, Henry,
Robert and Walter, who reside with their mother at Clifton Springs; and
Edward, residing at Ballston Springs, N. Y., all under the age of 21
years; and John, a resident of Depew, N. Y., who is of age. The
property after the payment of the debts of the decedent will be divided
among the widow and the nine children.

The surrogate has recently appointed Ethel Phelps Wilson administrator
of the estate of Mary A. Phelps of Geneva. The amount of the
estate is $10,200. Anna Renehan has been appointed
administrator of the $1900 estate of Edward Renehan of Phelps.

The will of Mary Hobart, who died in the town of East
Bloomfield, September 27, 1909, was admitted to probate without
objection. The will directed that Flora Hobart Munson, sister
of the decedent, should act as executor to close up the estate, and
accordingly the Surrogate ordered that letters testamentary be issued
to her. The executor is the sole legatee and devisee of the property.

Yesterday in surrogate's court judicial settlement was had in the
estate of Josephus Goodnow, late of Farmington, who died four
years ago. A decree was entered, distributing about $250,000 among
seven heirs. Disposition of this case has been held up because of the
fruitless effort to get trace of a son, who has never been located.
There is an unconfirmed rumor that he was killed while tramping in
Texas. Delay was also caused because of protest at the probate of a
will, which was said to have been one of several left by the deceased. Charles
Newton and Lucius t. Goodnow were finally appointed
administrators to settle the estate.
